Supreme Court of Canada Winds Claims Appeal By Sask Farmers’ Litigation Against Crop Insurance

A lower court certified the class action last year, but that decision was overruled by Saskatchewan's Court of Appeal

Saskatchewan farmers have reached the end in their bid to take a legal action in the province’s crop insurance corporation over a frost claim – reported in The Canadian Press.

The Supreme Court of Canada expressed that it won’t hear a petition from Michael Hicks and Leigh Stuart, who were trying to have a class action certified against the corporation. They claimed that it should have paid compensation after heavy frost hit in Glaslyn, north of North Battleford, in August 2005.

The farmers expressed that they were deprived of compensation because payment was based solely on information from a private weather station, which didn’t register the frost.

A lower court certified the class action last year, but that decision was overruled by Saskatchewan’s Court of Appeal in February.
